1. Acceptance of Terms
By registering for an account, accessing the Mailnexy platform, or utilizing our APIs, you acknowledge that you have read, understood, and agree to comply with these Terms, as well as our Privacy Policy. If you do not agree with any part of these terms, you may not use our service.
2. Account Responsibilities
When creating and maintaining your Mailnexy account, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password, API keys, and connected email accounts.
- Accept full responsibility for all activities that occur under your account, including the emails sent by your team members.
- Promptly notify us of any security breaches or unauthorized use of your account.
3. Acceptable Use Policy
Zero Tolerance Policy
Mailnexy is a B2B sales engagement tool, not a platform for spam. You agree NOT to use our service to:
- Send emails that violate the CAN-SPAM Act, GDPR, or other regional anti-spam laws.
- Send phishing emails, malware, or impersonate other businesses.
- Upload or email purchased, scraped, or unverified lists that result in excessively high bounce rates (above industry standards).
- Promote illegal goods, adult content, or engage in deceptive marketing practices.
4. Subscriptions & Payments
Mailnexy is a paid service. By subscribing, you agree to pay the fees associated with your chosen plan. All payments are processed securely via our third-party payment provider. Subscriptions renew automatically unless canceled prior to the end of the current billing cycle.
5. Suspension & Termination
To protect the deliverability infrastructure for all our users, Mailnexy reserves the right to immediately suspend or terminate your account without refund if we detect:
- A violation of our Acceptable Use Policy.
- Bounce rates or spam complaint rates that threaten our sending infrastructure.
- Failure to pay subscription fees.
6. Limitation of Liability
Mailnexy provides tools to help improve email deliverability, but we cannot guarantee inbox placement, open rates, or sales conversions. You agree that Mailnexy and its team shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including lost profits or lost data resulting from suspended email accounts by third-party providers (e.g., Google or Microsoft).
